1. Scope and Provider

These Terms & Conditions govern the use of the "Node Health" App, provided by:

By using the App, you acknowledge and agree to be bound by these Terms & Conditions.

2. Services of Node Health

The App enables structured recording, visualization, comparison, and analysis of personal health-related data.

The App is intended solely for informational and educational purposes. It does not provide medical diagnosis, monitoring, or treatment and does not constitute medical advice. Users must always consult qualified healthcare professionals before making health-related decisions.

2A. AI-Supported Data Processing

Certain Premium features include automated processing and analysis of user-entered health data using artificial intelligence systems.

• AI-generated results are based on statistical and algorithmic models.
• Outputs may contain inaccuracies or limitations.
• They do not constitute medical advice, diagnosis, or treatment recommendations.

Node Health UG makes no guarantee regarding the correctness, completeness, or medical validity of AI-generated results.

3. Authorization to Use

The App may only be used by natural persons who are at least 18 years old.
Use is exclusively for private, non-commercial purposes.

4. Free and Premium Services

4.1 Free Version

The Node Health App is available in a free basic version with limited functionality.

4.2 Premium Subscription

Certain features — including AI-supported processing of user data — are available exclusively through a paid Premium subscription. The scope of Premium features is displayed transparently within the App prior to purchase.

Premium AI features, including automated document scanning, are subject to reasonable fair-use limits to keep the service sustainable and prevent misuse. The limit currently applicable is 15 scanned document uploads per month per account. The allowance renews each month on the subscriber's billing date, and the number remaining is shown in the App at any time under Profile. Adding readings manually is not subject to this limit. Node Health UG may adjust the limit where reasonable, with advance notice within the App where the change is material. The figure stated here reflects the limit as at the last update of these Terms.

4.3 Free Trial

Node Health UG may offer time-limited free trials of the Premium subscription. Unless cancelled before the end of the trial period, the subscription automatically converts into a paid subscription. Cancellation must occur via the respective App Store settings. Deleting the App does not automatically cancel a trial or subscription.

4.4 Billing and Renewal

Subscriptions are billed in advance and renew automatically unless cancelled before the end of the current billing period. Payments are processed exclusively through the respective App Store and are subject to their terms and conditions.

4.5 Price Changes

Node Health UG reserves the right to adjust subscription fees in the future in accordance with applicable legal requirements. Users will be informed in advance where required by law.

5. Registration and User Responsibility

Registration is mandatory for using the App. The user is responsible for all data entered into the App and for its accuracy.

6. Data Protection

Processing of personal data — including health data — is carried out in compliance with the General Data Protection Regulation (GDPR).

Where Premium AI-based services are used, user data may be processed on secure cloud infrastructure or by processors acting on behalf of Node Health UG pursuant to Art. 28 GDPR. Further details are provided in the Privacy Policy.

7. Rights to Content and License

All content, designs, logos, source codes, and texts of the App are protected by copyright. Users are granted a simple, non-transferable, revocable right of use.

8. Availability and Changes

Node Health UG does not guarantee uninterrupted availability of the App. We may change, expand, restrict, or discontinue services where there is a valid reason, in particular to ensure the technical or economic sustainability of the service, to prevent misuse, or to comply with legal requirements. Where a change materially affects paid features, users will be informed in advance within the App, and the change will take effect no earlier than 20 days after users are so informed. In cases of manifest misuse, Node Health UG may apply limits with immediate effect.

9. Disclaimer of Liability

The App is provided for informational and educational purposes only.

In cases of slight negligence, liability is limited to foreseeable damages typical for the contract, except in cases involving injury to life, body, or health or mandatory statutory liability.

10. Amendment of the Terms & Conditions

Node Health UG reserves the right to amend these Terms where necessary and in compliance with applicable law. Users will be informed of significant changes in advance within the App. Continued use requires acceptance of the amended Terms.

11. Termination of Use

Users may cancel subscriptions via the respective App Store settings at any time. Deleting the App does not automatically cancel an active subscription.

12. Applicable Law and Jurisdiction

The law of the Federal Republic of Germany applies. The place of jurisdiction is Berlin, to the extent legally permissible.
